BIG ASIA Co., Ltd. (“BIG ASIA”, “we”, “our”, or “us”) issues these Terms of Service to clarify the rights and obligations between BIG ASIA and our customers (“you”) when using our services. By using our services, you acknowledge that you have read, understood, and agreed to the following terms.


I. GENERAL INTRODUCTION

1.1 Purpose and Scope

These Terms of Service govern the rights, obligations, and responsibilities between BIG ASIA and customers (individuals, organizations, distributors, or agents) who use our services, including purchasing assistance, international and domestic shipping, customs declaration, warehousing, and related logistics services.

1.2 Acceptance of Terms

By using our services (including via our website, applications, or other communication channels), you are deemed to have agreed to be bound by these Terms, regardless of whether a written contract has been signed.

1.3 Nature of Services

BIG ASIA provides international and domestic logistics solutions, purchasing assistance, import and customs clearance services, mainly from Japan to the Philippines and other countries. We act as an intermediary between the customer and sellers/shipping providers.


II. SERVICES PROVIDED

2.1 International Purchasing Assistance

  • Support in ordering from e-commerce platforms or suppliers in Japan and other countries as requested by customers.

  • BIG ASIA does not represent the seller and is not responsible for product quality or warranty.

  • Our responsibility is limited to payment handling, receiving, transporting, and customs clearance.

2.2 International & Domestic Shipping

  • Receive goods from partners, transport them to our warehouses in Japan and the Philippines, and deliver them to the requested address.

  • Includes warehousing, consolidation, repackaging, and delivery by economy or express services.

  • Delivery times may be affected by external factors (customs clearance, natural disasters, political issues, etc.).

2.3 Customs & Specialized Declarations

  • Perform customs declarations, pay import taxes, and handle specialized inspections if required.

  • In cases where goods are held, sealed, or delayed by authorities, BIG ASIA will assist but cannot take full responsibility.


III. CUSTOMER RESPONSIBILITIES

3.1 Providing Accurate Information

  • Provide accurate name, address, phone number, email, and tax identification (if applicable).

  • Declare all goods truthfully, including invoices and documents.

  • Ensure goods are legal, not restricted or prohibited under applicable laws.

3.2 Payments

  • Customers must pay in advance fully or partially according to BIG ASIA’s quotation.

  • Additional charges (import taxes, storage fees, carrier surcharges, specialized inspections, etc.) must be settled before delivery.

3.3 Goods Inspection & Receipt

  • Customers must inspect goods immediately upon receipt. Complaints made after 24 hours of delivery will not be accepted.

  • In case of shortages, damages, or incorrect goods, customers must provide photos/videos as evidence.


IV. BIG ASIA RESPONSIBILITIES

4.1 Service Commitment

  • Operate services transparently with published fees, schedules, and service conditions.

  • Provide accurate and timely updates regarding delivery and customs.

  • Assist customers in resolving issues with third parties if problems arise.

4.2 Data Protection

  • Protect all personal data, transactions, and customer information in accordance with our Privacy Policy.

  • We will not disclose customer information to third parties unless legally required.

4.3 Limitation of Liability

  • BIG ASIA is not responsible for product quality or warranty from sellers.

  • We are not liable for risks caused by customer errors (misdeclaration, prohibited items, false information).

  • We are not liable for damages caused by force majeure events (natural disasters, wars, embargoes, government restrictions, etc.).


V. GOODS REGULATIONS

5.1 Prohibited Items

  • Weapons, drugs, hazardous chemicals, currency, valuable assets (precious metals, securities, antiques).

  • Pornographic or illegal cultural materials, counterfeit goods, or goods without clear origin.

  • Live animals, flammable or explosive items, or food without proper inspection certificates.

5.2 Restricted Items

  • Cosmetics, supplements, electronics, and goods containing batteries may require invoices or supporting documents.

  • Oversized, bulky, or fragile goods must be packaged according to standards; otherwise, they may be refused.


VI. COMPENSATION & CLAIMS

6.1 Compensation Policy

  • If goods are lost or damaged due to BIG ASIA’s error, compensation will be as follows:

With cargo insurance:

  • Insurance fee: 8% of the declared value.

  • Compensation: up to 100% of the declared value.

Without cargo insurance:

  • Compensation: up to 2 times the shipping fee, not exceeding PHP 12,000 per order.

Third-party carriers:

  • BIG ASIA is not responsible for compensation in cases caused by third-party carriers. Compensation (if any) will be based on the third party’s policy.

6.2 Claim Submission

  • Claims must be submitted within 24 hours from the time of delivery.

  • BIG ASIA will review and respond within 7 working days after receiving valid claims.


VII. SERVICE MODIFICATIONS & TERMINATION

  • BIG ASIA reserves the right to amend these Terms to reflect business needs and legal requirements, with notice published on our website.

  • We reserve the right to suspend or terminate services to customers who violate these Terms, commit fraud, cause damages, or fail to make payments.

  • Customers may stop using our services at any time, but must settle all outstanding obligations.


VIII. GOVERNING LAW

These Terms of Service are governed by and construed in accordance with the laws of the Republic of the Philippines, where BIG ASIA has its principal office.
